1. Acceptance of Terms

By signing up for or using ReachBack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including businesses and their representatives.

2. Description of Service

ReachBack provides automated SMS communication tools for appointment-based businesses, including missed call follow-ups, no-show notifications, and appointment reminders. The Service is provided on a subscription basis.

3. SMS Compliance

By using ReachBack, you agree to:

  • Only send messages to individuals who have provided consent to receive SMS communications from your business.
  • Comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and local laws governing SMS communications.
  • Include opt-out instructions when required by law (e.g., "Reply STOP to unsubscribe").
  • Honor all opt-out requests promptly.
  • Not use the Service for spam, harassment, or any unsolicited commercial communications.

You are solely responsible for ensuring that your use of the SMS features complies with applicable law. ReachBack is not liable for any violations resulting from your use of the Service.

4. Subscription and Billing

ReachBack is offered on a monthly subscription basis at the rates listed on our pricing page. You agree to pay all fees associated with your chosen plan. Subscriptions automatically renew each month unless canceled. A one-time setup fee may apply. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.

5. Free Trial

We offer a 14-day free trial. After the trial period, you will be charged the applicable subscription fee unless you cancel before the trial ends. No credit card is required to start a trial.

6. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate and complete information when creating your account. You may not share your account credentials with third parties.

7. Acceptable Use

You may not use ReachBack to:

  • Send spam or unsolicited messages
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit harmful, threatening, or offensive content
  • Attempt to gain unauthorized access to our systems

8. Third-Party Services

ReachBack integrates with Twilio for SMS delivery and Stripe for payment processing. Your use of these services is also subject to their respective terms of service and privacy policies. ReachBack is not responsible for the availability or performance of these third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, ReachBack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising out of your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. You remain responsible for any charges incurred before termination. We may suspend or terminate your account immediately if you violate these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated terms.
